  In order to optimize the business environment,deepen the reform to streamline administration, delegate power, improve regulationand upgrade services, and fulfill the requirements for piloting business environment innovation, according to the Opinions of the State Council on Piloting Business Environment Innovation (Guo Fa [2021] No. 24), and based on the actual situation of Guangzhou, this bureau formulates the Implementation Measures for Joint Environmental Impact Assessment for Industrial Park Planning and Construction Projects in Guangzhou. It is hereby printed and distributed for implementation.

Implementation Measures for Joint Environmental Impact Assessment for Industrial Park Planning and Construction Projects in Guangzhou

  In order to implement the Opinions of the State Council on Piloting Business Environment Innovation (Guo Fa [2021] No. 24), the Notice of the Department of Ecology and Environment of Guangdong Province on Further Improving PlanningEnvironmental Impact Assessment for Industrial Parks (Yue Huan Han [2021] No. 64) and the Notice of Guangzhou Municipal Peoples Government on Printing and Distributing the Implementation Plan for Building National Pilot Cities for Business Environment Innovation in Guangzhou(Sui Fu [2022] No. 1), implement the requirements of “three lines and one list” for eco-environmental zoning control(ecological red line, environment, quality bottom line, resource use upper line and environmental access negative list), give full play to the macroleading function of planning environmental impact assessment (hereinafter referred to as “planning EIA”), continuously optimize the business environment, promote jointEIA for industrial park planning and construction projects (hereinafter referred to as “project EIA”) and promote the quality and efficiency of project EIA, and based on the actual situation of Guangzhou, this Implementation Measuresis formulated.

  1. Basic Requirements

  As for industrial parks whose environmental quality meets relevant national assessment requirements witha relatively soundenvironmental management system, the joint reform of planning EIA and project EIA should be carried out. As for constructionprojects settled in industrial parks, according to their environmental impact and environmental risks, we should optimize EIA procedures in a classified manner, strengthen in-process and post-process supervision, adjust the management mode, improve management efficiency and deepen the reform of the review system so as to promote high-quality development of industrial parks.

  2. Implementation Scope

  2.1 Economic and technological development zones, hi-tech industrial development zones, tourist resorts, pilot free trade zones, industrial transfer parks and other industrial parks founded as approved by the State Council, its relevant departments and provincial governments, as well as other industrial parks founded as approved by municipal governments.

  2.2 Industrial clusters developed based on industrial parks and industrial concentration areas founded as approved by district governments.

  3. Application Conditions

  An industrial park to implement joint planned EIA and project EIA should simultaneously meet the following conditions:

  3.1 The industrial park has clear industrial development directions, geographical boundaries and administration bodies;

  3.2 The industrial park has completedplanning EIAaccording to lawand adopted and implemented planning EIA conclusions and review opinions;

  3.3 The industrial park’s environmental quality meets relevant national assessment requirements;

  3.4 The industrial park has sound environmental infrastructure and operates stably;

  3.5 The industrial park has sound environmental management and risk prevention and control systems, and no major environmental incidents have occurred in the past five years.

  The list of specific industrial parks to implement joint planning EIA and project EIA should be released by Guangzhou Municipal Ecological Environment Bureauaccording to the principle of “promoting joint planning EIA and project EIA among industrial parks with mature conditions one batch after another”.

  4. Joint Implementation Contents and Requirements

  EIA procedures can be optimized forconstruction projects settled in industrial parksif they meet the requirements of “three lines and one list” for eco-environmental zoning control and environmental access to planning EIA, as well as the industrial positioning of industrial parks.

  4.1 Exemption from EIA procedures

  Construction projects exempt from EIA procedures should implement relevant environmental protection measures to prevent environmental pollution and ecological damage, and should be included in discharge permit administration according to relevant provisions and subject to the supervision and administration of ecological environment departments.

  4.1.1 According to relevant provisions of the Classified Management List of Environmental Impact Assessment for Construction Projects (2021 edition; hereinafter referred to as the “List”), construction projects that should submit the environmental impact registration form may be exempted from registration procedures for the environmental impact registration form.

  4.1.2 The following construction projects may be exempt from EIA procedures:

  4.1.2.1 Plastic products (consuming less than 10 tons of non-solvent-based low-VOCs coatings every year);

  4.1.2.2 Casting and other metal products (segmenting, welding and assembling only);

  4.1.2.3 Intelligent consumption equipment (segmenting, welding and assembling only);

  4.1.2.4 Standard plants (no environmentally sensitive areas involved);

  4.1.2.5 Professional laboratories (no production of experiment-related waste gas, waste water or hazardous wastes);

  4.1.2.6 Construction projects not involving the storage, logistics and distribution of toxic, harmful and dangerous chemicals;

  4.1.2.7 Renovation projects not involving new construction land or increasing types and quantities of pollutants discharged.

  4.2 Simplification of EIA procedures

  According to relevant provisions of the List, relevant assessment contentsmay be simplified for construction projects which should prepare the environmental impact report (statement), including:

  4.2.1 Policy and planning compliance analysis, rationality and feasibility demonstration of site environment of construction projects in line with planning EIA conclusions and review opinions;

  4.2.2 Investigation and assessment of regional ecological environment status in line with timeliness requirements (except for those with declining regional environmental quality or new characteristic pollutants);

  4.2.3 Related assessment contents to prove that central heating, sewage treatment, solid waste treatment and disposal, transportation and other infrastructure supporting construction projects have been constructed and operated according to planning EIA requirements.

  4.2.4 Compilation basis, environmental function zoning, environmental status investigation and assessment, economic profit and loss analysis on environmental impact, or existing contents or data in the regional environmental management status assessment report so no separate preparation or investigation is needed.

  4.3 Packaged review

  According to relevant provisions of the List, packaged EIA review may be carried out and requirements for pollution prevention and control should be put forward in a unified manner for construction projects of the same category which should prepare the environmental impact report form (except for those requiring special assessment) if corresponding responsible bodies are specified. EIAshould not be carried out repeatedly for any individual project.

  5. Declaration and Identification

  Guangzhou Municipal Ecological Environment Bureau should organize and coordinate the identification of industrial parks qualified for joint planning EIAand project EIA according tothe requirements of “three lines and one list” for eco-environmental zoning control and planning EIA, and the planning EIA progress. Administrative authorities of industrial parks (or district people’s governments) should organize declaration of industrial parks within their jurisdiction (or industrial parks to be included in piloting joint planning EIA and project EIA within their jurisdiction). Relevant procedures are as follows:

  5.1 Declaration. For industrial parks that meet relevant requirements of “3. Application Conditions” hereunder, administrative authorities of industrial parks (or district people’s governments) may declare on a voluntary basis. In principle, declaration should be made every six months (at the end of June and December each year).

  5.2 Identification. After receiving declaration materials submitted by administrative authorities of industrial parks (or district people’s governments), Guangzhou Municipal Ecological Environment Bureau should organize its sub-bureaus within its jurisdiction where the industrial parks are located to initiate identification and report identification results.

  5.3 List release. Guangzhou Municipal Ecological Environment Bureau should release the list of industrial parks qualified for joint planning EIA and project EIA and the time limit.

  6. Job Security

  Guangzhou Municipal Ecological Environment Bureau, administrative authorities of industrial parks and enterprises (construction units) settled in industrial parks should work together to promote high-quality joint planning EIA and project EIA, effectively play the role of planning EIA in optimizing the industrial layout and ecological safety pattern, and promote high-quality economic development.

  6.1 Guangzhou Municipal Ecological Environment Bureau should strengthen its service quality and supervision. Guangzhou Municipal Ecological Environment Bureau should publicize policies about joint planning EIA and project EIA, strengthen in-process and post-process supervision for relevant projects settled in industrial parks, strengthen the inspection of planning EIA for industrial parks, and build a comprehensive supervision system involving the government, enterprises and the public by launching double random inspections and strengthening information disclosure and public supervision. Besides, it should strengthen environmental monitoring for industrial parks included in joint planning EIA and project EIA, clarify environmental risk prevention responsibilities of industrial parks and enterprises in industrial parks, timely handle construction projects that damage the ecological environment according to laws and regulations, and terminate joint planning EIA and project EIA for industrial parks that have major environmental problems in the joint implementation process or no longer meet relevant requirements of “3. Application Conditions” hereunder.

  6.2 Administrative authorities of industrial parks should strengthen overall management. Administrative authorities of industrial parks should organize and carry out the preparation of planning EIA documents according to law, strictly implement planning EIA conclusions and review opinions, and focus on total pollutant quantity control and emission reduction; organize and carry out environmental monitoring for industrial parks, organize rectification of existing eco-environmental problems, and guarantee the fulfillment of the responsibility of ecological environmental protection; in case of any changes in the boundaries of industrial parks and major adjustment or revision of planning orientation and layout, carry out anew or supplement planning EIA according to law; for planning that may lead to regional environmental quality degradation, ecological function degradation or other major impacts on the environment and have been implemented for more than five years without major adjustment, carry out environmental impact tracking assessment in a timely manner according to regulations; carry out environmental management status assessment according to relevant regulations, and disclose relevant information in a timely manner.

  6.3 Enterprises (construction units) settled in industrial parks should fulfill the main responsibility of eco-environmental protection. Enterprises (construction units) settled in industrial parks should strictly abide by relevant laws and regulations on ecology and environment, earnestly fulfill the main responsibility of eco-environmental protection, fulfill the responsibility of environmental risk prevention, take various eco-environmental protection measures, complete various environmental protection tasks such as the construction and operation of supporting pollution prevention facilities, self-monitoring, environmental information disclosure and so on to ensure the discharge of pollutants up to relevant standards; according to relevant requirements for environmental protection management of construction projects, make good environmental protection design and implement eco-environmental protection requirements specified by laws, regulations, standards and technical specifications.

  ThisImplementation Measuresshould come into force as of January 1, 2023 and should be valid for two years. During the implementation of this Implementation Measures, if the State promulgates or adjusts the provisions of relevant laws, regulations and documents, such provisions should prevail.
