All relevant units:

  In order to deepen the reform to streamline administration, delegate power, improve regulation, and upgrade services, speed up the orderly transfer of urban land and optimize the business environment, the following notice concerning soil environment administration for the redevelopment and utilization ofland for construct is hereby issued.

  1. Narrow the scope of examination for investigation reports

  In the following 4 cases, investigation reports on soil pollution status should be examined, while other cases can be exempted from the examination:

  1.1A construction land with soil pollution risks according to a general survey, detailed investigation, monitoring and field inspection on soil pollution status;

  1.2A land converted to a residential, public management and public service land (in principle, there is no need to investigate the conversion among a residential land, a public management land and a public service land, except that a land for sanitation facilities or sewage treatment facilities of a public management land or a public service land is converted to a residential land);

  1.3A production and operation land of a key unit under soil pollution supervision whose use is converted or land use right is taken back or transferred;

  1.4A land of a company which has been engaged in non-ferrous metal mining, metal smelting, petroleum processing, chemical engineering, coking, electroplating, leather manufacturing, paper making, printing and dyeing, car dismantling, shipbuilding, pharmaceutical manufacturing, lead-acid battery manufacturing, waste electronic products dismantling and hazardous chemical manufacturing, storage and use, etc., a land used for hazardous waste storage, utilization and treatment, and a land for thermal power generation, gas production and supply, waste landfill, waste incineration, municipal and industrial park sewage treatment and sludge treatment, whose use is converted or land use right is taken back or transferred;

  Land use right holders and construction units should pay close attention to the soil or groundwater environment when developing and using land plots that are exempt from the examination of investigation reports on soil pollution status. Once abnormal color, odor, pollution trace and other abnormal conditions are found, they should immediately stop construction and other related operations, take measures to control pollution sources, cut off exposure routesto protect construction personnel, ensure environmental safety, and timely report to ecological environment authorities.

  2. Simplify the investigation ofagricultural land converted to land for construct

  The investigation of soil pollution status for a agricultural land converted to a land for construct should be conducted by land users according to relevant work technical guidelines of Guangzhou. The investigation can be simplified to seven indicators. Plots that have passed the simplified investigation should be exempt from sampling and monitoring.

  3. Implement hierarchical examination for investigation reports

  Municipal ecological environment authorities and natural resource authorities should organize the examination of reports involving detailed investigation of soil pollution status, while district ecological environment authorities and natural resource authorities should organize the examination of reports involving only preliminary investigation of soil pollution status.

  Land use right holders should submit investigation reports to examination authorities according to the type of investigation reports.

  4. Shorten examination time

  Municipal ecological environment authorities should speed up the examination of investigation reports on soil pollution status and shorten the examination time to 30 working days by conducting monitoring, quality supervision, inspection and report, technical assessment, etc. in a paralleled manner.

  5. Cancel the examination for restoration plans

  Municipal ecological environment authorities should file restoration plans for later reference in accordance with the law, cancel expert examination, technical assessment, etc. of restoration plans, cancel joint handling with natural resource authorities, and further simplify the filing process.

  6. Strengthen oversight over restoration projects during the process

  Municipal and district ecological environment authorities should earnestly fulfill key points in environmental protection inspection at soil pollution restoration sites for construction land in Guangzhou. Besides, from the perspectives of environmental management procedures, pollution prevention and control measures, environmental complaints, and construction of projects unrelated to restoration plans, they should strengthen environmental supervision during the restoration construction, urge the progress in soil pollution control and restoration and prevent secondary pollution during the restoration.

  7. Strengthen guidance and service

  Municipal ecological environment authorities should strengthen the guidance and service for units engaged in soil pollution risk control and restoration, organize and hold professional training, build a communication platform, and timely answer questions from units engaged in soil pollution risk control and restoration. Municipal and district ecological environment authorities should strengthen the guidance and service in soil pollution investigation, provide policy interpretations for land use right holders, offer targeted guidance and technical consultation on specific plots, and solve practical difficulties.

  ThisNotice should come into force as of the date of printing and distributing and be valid for two years.
