In order to implement the relevant work arrangements of theNotice of the General Office of the State Council on Carrying out the Pilot Reform of the Examination and Approval System for Construction Projects (Guo Ban Fa No. 33) and the Notice of the People's Government of Guangzhou on Printing and Distributing the Implementation Plan of the Pilot Reform of the Examination and Approval System for Construction Projects in Guangzhou (Sui Fu No. 12), and further deepen the reform of "strengthening regulation and services" in environmental impact assessment, improve the quality and efficiency of approval and approval for environmental impact assessment, promote the transformation of government functions in reducing approval, strengthening regulation and providing better services, vigorously optimize the business environment and ensure high-quality economic development. We hereby notify the following:
1.Further carry out planning environmental impact assessments and carry out regional assessments
1.1.Carry out environmental impact assessment according to law. The relevant departments of the municipal government, the district government and the district administrative agency shall make specific regional plans and special plans for key industries (except guidance plans) for various development zones, functional parks, industrial blocks, industrial or industrial parks, value innovation parks, parks under IAB and NEM industrial projects organized and compiled by them, and before the draft plan is submitted for examination and approval, an environmental impact assessment shall be conducted and the environmental impact report shall be submitted to Guangzhou Municipal Ecological Environment Bureau for examination and approval. The planned environmental impact statement shall contain, but not be limited to, the following list of conclusions: A list of ecological space under key protection, a list of regional pollutant discharge standards and total quantity control limits, and a list of regional environmental access conditions. The conclusion of the environmental impact assessment of planning should be used as an important basis for the environmental impact assessment and construction of construction projects, which shall be announced and publicized by the planning and compilation organs, regional management organs and the competent departments of ecological environment at all levels to the construction subjects of specific regions.
1.2.Take an active part in the government's macro decision-making. Authorities in charge of ecological environment at all levels should establish and improve the front-line service mechanism for environmental protection, fully rely on various consultation institutions and joint meeting platforms, and strengthen communication and coordination with project authorities, regional management agencies and other relevant departments, share government information, grasp the preliminary formalities of urban planning, land use, investment attraction and so on in the stage of project approval, land use and planning, cooperate with the generation of major project planning and the review of engineering technical schemes, and put forward the requirements of environmental protection management.
2.Deepen the reform of project EIA and improve the business environment
2.1.Simplify approval procedures
2.1.1.In principle, construction projects not specified in the Environmental Impact Assessment Classification Management Directory of Construction Projects (except emerging industrial projects with high environmental impact or environmental risk) shall not be included in the environmental impact assessment management. In order to facilitate the work of enterprises and the public, Guangzhou Municipal Ecological Environment Bureau formulated a list of construction projects that are not included in the management of environmental impact assessment based on the local conditions of Guangzhou.
2.1.2.There is no need to submit an environmental impact assessment document for renovation projects that have legal procedures in the early stage, do not involve new land use, have no major changes in the nature, scale and production process of the project, and do not increase the types and discharge of pollutants, and the construction unit shall organize environmental impact analysis and demonstration by itself before the project starts construction, disclose relevant environmental information, make a written commitment to the competent department of ecological environment and bring it into daily supervision. If a pollutant discharge permit is required, the pollutant discharge permit shall be changed.

2.2.Optimize the approval process
2.2.1.The examination and approval of environmental impact assessment shall be completed before the construction permit of the project, and shall be carried out in parallel with the examination and approval of the project approval, planned land use, preliminary design, water and soil conservation plan, etc., and shall not be a precondition for the examination and approval, approval or filing of the project. The competent departments of ecological environment at all levels should take the initiative to provide services, intervene in advance, carry out the approval and scheduling of major projects, urge and guide the construction units to carry out environmental impact assessment in the early stages of project approval, land use and planning, and reasonably arrange the time for application for approval.
2.2.2.Separate administrative approval from technical review. For the construction projects requiring technical assessment, the technical assessment institutions shall carry out technical review before submitting the environmental impact assessment documents of the construction projects for approval. After the acceptance of the environmental impact assessment documents, the technical assessment institution shall issue technical assessment opinions to the competent department of ecological environment.
2.3.Simplify the preconditions of examination and approval
Administrative matters without legal basis, such as the preliminary examination opinions of the competent departments of industry, towns and streets (villages) and water and soil conservation plans, shall not be taken as the preconditions for the examination and approval of environmental impact assessment. In cases where it is necessary to solicit opinions from administrative departments in charge of marine affairs, maritime affairs, fishery and wetland, as well as environmental protection departments of the armed forces in accordance with relevant laws and regulations, the competent department of ecological environment shall handle the matter by soliciting opinions from the departments concerned or the construction unit shall undertake to handle the matter.
Improve the total amount management, and bring the total amount review into the internal process of examination and approval for projects that need to increase the discharge of key pollutants (nitrogen oxide, sulfur dioxide, ammonia nitrogen, chemical oxygen demand, volatile organic compounds, heavy metal lead, mercury, cadmium, chromium, arsenic, etc.).
2.4.Delegate the power of examination and approval
With the principle of decentralization and the exception of no decentralization, the municipal government shall implement the work plan of strengthening the district by delegating power. In principle, except for national, provincial or cross-district construction projects, each district department in charge of ecological environment shall, in principle, be responsible for the examination and approval of the environmental impact assessment documents of construction projects within its jurisdiction. The specific list of approval shall be promulgated and implemented by Guangzhou Municipal Ecological Environment Bureau.
2.5.Simplify the content of EIA
Strengthening planning environmental impact assessment and the linkage of the environmental impact assessment of construction projects, and making the environmental impact assessment for the specific projects that are included in the planning, environmental impact assessment content may be duly simplified, regional project environmental impact assessment and planning environmental impact assessment Shared environment quality present situation, the pollution sources investigation data, the environment present situation investigation and evaluation chapters can be simplified.
2.6.Reduce approval time
Improve examination and approval services, open up green channels for major infrastructure projects, projects related to people's livelihood, and key industrial layout projects such as the IAB and NEM, speed up the process, and improve the efficiency of examination and approval. In principle, the approval time of EIA should be reduced to half of the statutory time limit, the approval of environmental impact statement should be completed within 30 working days, and the approval of environmental impact report form should be completed within 15 working days.
3.Strengthen environmental supervision and management and standardize intermediary market services
3.1.To implement the requirements of the Implementation Opinions on Strengthening The In-process and Ex-post Supervision of Environmental Impact Assessment on Construction Projects (Huan Huan Ping No. 11), carry out oversight under the principle of "Two random projects, one open," strengthen supervision and inspection of environmental protection and the operation process of “3 synchronous construction projects”, and strictly investigate and punish violations of laws and regulations. Strengthen the main responsibility of environmental protection for construction units, and refuse to implement the notification of approval and commitment system for construction projects with environmental violations. For construction projects under the system of approval and notification of commitment, the competent ecological and environmental authorities shall inspect the fulfillment of the commitments by the construction units within the prescribed time. In case of any of the following circumstances, measures shall be taken to rectify within a time limit, order the construction to stop, cancel the qualification of "applying for administrative examination and approval by informing commitment system", record bad behavior, cancel the decision of administrative examination and approval and other measures according to relevant provisions, and the relevant responsibilities of the construction unit shall be investigated in accordance with the law, and the construction unit shall bear the legal responsibilities and all economic losses resulting from the violation of the commitment.
3.1.1.The construction unit fails to fulfill its commitment;
3.1.2.The actual situation of the construction unit is seriously inconsistent with the content of the commitment, which may have serious consequences;
3.1.3.The construction unit fails to submit the materials within the promised period or the submitted materials do not meet the requirements.
3.2.Implement the relevant regulations on joint punishment for dishonest producers and business operators in the field of ecological and environmental protection, disclose the dishonest information of relevant units to the public, and implement joint punishment.
3.3.Strengthen the management of environmental impact assessment agencies and strengthen the assessment of the quality of environmental impact assessment documents, and in accordance with the relevant provisions of the Environmental Impact Assessment Law of the People's Republic of China, Regulations on the Administration of Environmental Protection for Construction Projects, and Measures for the Administration of the Qualification of Environmental Impact Assessment for Construction Projects, the EIA agencies shall be dealt with according to law for their irresponsible or fraudulent conduct in EIA work.
4.Improve supporting institutions and promote effective reform
4.1.Unify the understanding. Authorities in charge of ecological environment at all levels should fully recognize the importance and urgency of the reform of environmental impact assessment. Under the guidance of Xi Jinping Thought on ecological civilization, we should consciously enhance our sense of responsibility and mission, strengthen organizational leadership, clarify responsibilities, refine division of labor, and strengthen coordination, so as to form synergy and promote the smooth progress of the pilot reform of environmental impact assessment and achieve tangible results.
4.2.Unify management. Gradually form the environmental impact assessment management mode of "one game of chess" in the whole city, carry out "one service guide, one acceptance list, one approval platform, one approval template", and realize the standardization of environmental impact assessment approval.
4.3.Unify examination and approval. Vigorously improve the online application and approval functions of environmental impact assessment for construction projects, and strengthen the information interconnection between ecological and environmental authorities at all levels to ensure the real-time submission of the approval process and results. Formulate and improve the approval principles of environmental impact assessment documents, and unify the approval criteria.
This notice shall take effect as of the date of issuance and shall remain valid for three years. TheNotice of Guangzhou Environmental Protection Bureau on Further Deepening the Reform of Environmental Impact Assessment by Carrying out the Pilot Reform of the Examination and Approval System for Construction Projects(Sui Huan Gui Zi  NO.3) shall be repealed at the same time.
